The question of whether transgender individuals can use the bathroom of their choice is shaping up as a battle between states’ rights and the federal government. North Carolina is currently suing the federal government, saying it overstepped its authority by trying to prevent the state from requiring transgender individuals to use the bathroom that corresponds with their birth gender.

The federal government says North Carolina’s law, and others like it, amount to sex-based discrimination. It has threatened to withhold funds.

On May 13 the debate stepped up another notch when in a surprise move the Obama administration issued guidance directing public schools to allow transgender students to use bathrooms and locker rooms consistent with their chosen gender identity. The guidance from leaders at the departments of Education and Justice says public schools are obligated to treat transgender students in a way that matches their gender identity, even if their education records or identity documents indicate a different sex. According to the administration, the guidelines are meant to ensure that "transgender students enjoy a supportive and nondiscriminatory school environment."

Even before the latest move by the Obama administration, school systems across the country had been re-evaluating their policies regarding bathrooms and locker rooms. Their response could offer clues as to how the question ultimately gets resolved.

Several Midwest schools began examining their policies in the wake of a case in Palatine, Ill., a largely white, affluent community in the northwest suburbs of Chicago. The issue was whether a Palatine High School student transitioning from male to female would be allowed to change in the girls’ locker room.

The teen, identified only as “Student A” in public documents, was already playing on a girls’ athletic team. She had been on a regimen of female hormones since middle school and has an official diagnosis of gender dysphoria—a severe discomfort with one’s birth gender. School records identified her as female.

The civil rights office of the U.S. Education Department found that excluding Student A from the girls’ locker room violated Title IX, which prohibits sex-based discrimination in sports. The department threatened to withhold funding. Ultimately, the school district reached a compromise. It agreed to allow the student to change clothes in the locker room, behind a curtain.

Changing hearts has proved another matter. Six female students sent a protest letter to the local school board. “Although we will never fully understand your personal struggle,” they said, addressing the transgender student in their letter, “Please understand that we, too, all are experiencing personal struggles that need to be respected.”

The girls told the school board, “It is unfair to infringe upon the rights of others to accommodate one person.”

School systems across the country have noted the Education Department’s threat to Palatine. Some are responding proactively.

Unlike Chicago, central Illinois is a largely socially conservative, Republican-leaning agricultural area of the state. Unit 5, one of the largest school districts in that part of the state, recently amended its bathroom and locker room polices to accommodate transgender students. District 87, a nearby school system, is also considering a change.

“We’re trying to create an environment where students can be educated without fear of being harassed and bullied and be free to be who they are,”  Unit 5’s attorney and human resources director Curt Richardson told me.

Unit 5 wasn’t under threat of a lawsuit and did not face a noisy public outcry for more liberal bathroom rules. But the Palatine case weighed heavily in its decision, Richardson said. “This is a developing area of the law. So we were trying to be on the forefront of that and be progressive,” he said.

Some parents have expressed concern. Richardson says he tells them, “If you’ve ever been around trans individuals, the amount of harassment they receive is just tremendous and then [there is] the correlation to suicide rates among transgender individuals. So you have to ask yourself, why would anyone subject themselves to that kind of harassment just to get in the girl’s restroom?”

It is likely only a matter of time before the debate over transgender rights arises in Catholic schools. It is already happening.

I recently spoke with a student from an Illinois Catholic high school who was born female and now identifies as male. The student said administrators were uncomfortable discussing the transgender experience, let alone changes to bathroom or locker room policies. He said he had been sent home on one occasion for wearing a suit and tie to a school dance. Many teachers and students, he said, continue to call him by his female given name, though he had asked to be called by his preferred male name.

“It’s really hard to be in class and just trying to learn, and somebody calls out your birth name and it’s like, oh, that’s not my name,” the student said. “It’s really embarrassing and it makes me feel bad. And even though it’s all the time, it still hurts.”

The student is active in several school clubs and has many friends among classmates but says he is considering transferring to another school for senior year. He wishes he could stay. “This is not something that is new, this is not some phase or fad that is going on right now. These are my feelings, this is who I am, this is part of me and part of the world,” the student said. “There are so many people that are like me that are normal, people who just want to live their lives and not be hurt every day.”

Unit 5’s process could serve as a model for other school systems and private schools. The transgender policy changes were made after a year of extensive consultations between school officials and transgender rights activists, including graduates of Unit 5 schools. The policy only covers students who have an official diagnosis of gender dysphoria or who already have changed their gender on a document such as a birth certificate or driver’s license.

Cameron Hurley, a transgender graduate of Unit 5 schools who worked for the changes, said Catholic and private schools don’t face the same pressure as publicly funded schools to accommodate transgender students. In the case of Catholic schools, transgender students who seek change will have to “fight on their own. It’s going to have to be a private fight outside of government,” he said.

Hurley says one of the biggest arguments for giving transgender individuals the right to choose their restroom is that they put themselves at risk if they use a bathroom that corresponds with their anatomy but not how they look.

“I pass as male, and if you’re going to force me to use the women’s restroom because I haven’t changed my anatomy to your liking that could be reported as a man in the women’s restroom, and then it becomes dangerous when police become involved in things like that,” Hurley said.

“Trans people are like everyone else. They want to go into the bathroom, do what they have to do and get out,” Hurley added. In states that have anti-discrimination laws, there have been no reported incidents of anyone being attacked by a transgender person in a public restroom, he said.

Some 200 cities and 17 states have adopted measures allowing transgender people to use the public bathrooms of their choice. And though a backlash has begun—witness the North Carolina law among others—the debate isn’t going away. Instead of ignoring the issue, Catholic schools would do well now to begin to formulate a compassionate response.

It seems to me the most pressing question for the Catholic in such a situation is to do what's best for all individual's concerned. Some issues that need to be addressed: 1. The principle of Subsidiarity would favor handling this at the local level (where schools are run) and certainly not at the federal level, and not by an executive order where the people's representatives have no say. 2. The parents should have a major say in what is done at a public school that they are paying for (with taxes). 3. If the school has a religious mission, then the Church/Synagogue/Mosque should determine the rules for their private school. 4. Are we talking showers as well as bathrooms? People with male anatomies having showers with girls? It appears the Obama administration is including showers. Will the Obama administration provide insurance for sex abuse? 5. If the majority of a group (girls) feel uncomfortable showering with a person who has male genitalia, why is it fair to punish them for the sake of the other, especially when less draconian solutions are at hand (single bathroom/showers)? 6. When someone feels a conflict between their biological identity and their psychological identity, why is it the most charitable to favor conforming the anatomy to the psychology, especially when that choice involves mutilating surgery and a high incidence of suicidal dissatisfaction with the consequences (note reports that Caitlyn Jenner is now considering de-transitioning)? The gay political movement has been arguing that homosexuals are "born that way" and that gayness is somehow genetic and immutable (despite multiple examples to the contrary and the "discovery" of gayness well into adult life). The trans movement is taking the position that the genes must be overruled by the psychological desire and that gender is mutable.

In my experience, girls' locker rooms have shower and toilet stalls with doors that are closed for privacy. I remember at a summer school session at a Catholic college in 1975, a group of us women were placed in a men's dorm. The shower facilities were one big room with 8-10 shower heads and no shower curtains or doors. I was shocked. We did ask for shower curtains.

I was in high school in the early 70's and the girls had one big shower room with multiple shower heads. It was a most uncomfortable situation. I cannot imagine a transgender person or anyone else in the room being comfortable with that kind of situation. Bathrooms and shower rooms may not provide much privacy and the laws have to take that into account.

What will eventually come out in the wash is that transgederism affirms an identity disorder as no disorder at all. Once the identity is affirmed as an actual identify, we will have to affirm all sexual identitity disorders as real identities. In Holland a man married himself after declaring himself an onanist. The irony is that once you legally affirm that an identity disorder is no disorder in fact, then, to avoid discrimination, one cannot be selective.

It is my understanding that "transgender" means that the genitalia have been surgically altered so that the person IS now physically of the sex that he or she previously was not. The law in North Carolina that the Obama Administration is now taking issue with would require the OPPOSITE of what you folks think it would: it would REQUIRE that somebody who has been surgically altered from a female into a male would be required to bathe with females. Do you want that? The fact is that all of this hullabaloo over bathrooms for the "transgendered" is a tempest in a teapot created by the "culture warriors" of the Right to drum up political support for their agenda of setting back the civil rights movement for gays. Ever since Jan Morris, the "transgendered" have been excreting and showering in the bathrooms and locker rooms of their new sex, and their hasn't been a single recorded "incident." Girls in locker rooms and showers are much more in danger from heterosexual predators than they are from the "transgendered," and you folks actually KNOW that, but prefer to harp on this silly issue. The Obama Administration is correct, and I am glad they are standing up for minority rights in primitive places like North Carolina.

Robert - you are not correct. The cases in high school that I have read about are before any surgery, which makes sense, as mutilating surgery on a teenager who is only "discovering" their gender psyche would amount to child abuse. Note the school was very accommodating - the school built 3 new single bathrooms so G.G. would not be inconvenienced. Except that G.G. insisted she be able to use the boys bathroom and showers while biologically female. The instigators of this culture war are mainly on the left. The Obama administration is making this school issue a federal issue. Maybe, they are looking for a distraction.

The school districts and the States could simply make the argument in court, then, that they WILL accommodate, but AFTER surgery, and they will win. There are reasonable "leftist" judges and reasonable "leftist" members of the Executive Branch. I repeat, you know perfectly well that the "transgendered" have been bathing and showering with members of their new sex since the 1960s at least, with no adverse consequences. This is the RIGHT's "culture war" and your obfuscations will not alter that. Robert - you remain several steps behind on this and haven't read the legal brief. While it is reasonable middle ground to say that physical anatomy should determine the bathroom to use, that is NOT the leftist position, which, just like the gay marriage campaign (not a right wing campaign) is to deny or attack our physical biological nature, a clearly unscientific stance. The Catholic objection is also not just American. See the AL quote above from Pope Francis.

I think that YOU do not realize that "transitioning" from one gender to the opposite is a process that is not accomplished by just one surgery. If a person is in the physical process of changing gender, and wants to use the bathroom of the gender into which he or she is "transitioning," I see no problem with it. You, like the folks being interviewed HERE, have no answer to the question, “What bathroom should I use?” being asked by members of the transgendered minority, and you have no answer to the question whether someone with “full facial hair” but who was once a female should be forced to use the ladies room. Robert - you have already departed from your anatomical "compromise." Sex is defined at the chromosomal stage in all mammalian species. Gender, as currently used by politicians and the LBGT movement and their supporters, has only recently been severed from sex as an Orwellian move to buttress an ideology. It is devoid of hard scientific support, although, like the Marxist and Fascist regimes of the last century, they will vehemently claim scientific support. So Pope Francis is more correct, scientifically and rationally. That said, gender dysphoria still needs a compassionate response. But that response shouldn't include a denial of the hard lines between the sexes and should not disrupt the 99.7% to pander to the 0.3%. Single person bathrooms and showers are the obvious solution to anyone experiencing this dysphoria.

I don't know if you are aware of it, but Hinduism and Tibetan Buddhism have much more enlightened and liberal views of the theology of sex and sexual awareness than Semitic religions like Christianity and Judaism do. They CAN find a place of reverence in their systems for the "in-between" or the "two-spirited," as so can most Native tribes in the Americas.

You said this would be acceptable to "reasonable "leftist" judges and reasonable "leftist" members of the Executive Branch." So, that would mean a requirement pre-surgery would be unreasonable. Or, you have abandoned your anatomical position. In the patheos article you linked to, the LGBT advocate Brandan Robertson concedes “At most, the mandate may lead many schools to create gender neutral, single stall restrooms, eliminating the problem altogether.” Really? Then why force this based on self-identification gender alone, at the Federal level no less? Where is the hard (physical) science, the falsifiable study, the objective evidence that doesn't rely on self-identification? For that matter, why do you give credibility to just a "two-spirit"? Why not multi-spirit or reincarnated spirit or male on even days and female on odd days, etc. All of these ideas rest in the mind (intellect and will), with no physical evidence. Look at the recent news about Senator Wooford or Maria Bello, and their request not to be categorized as gay or straight or bi. We were promised that gay marriage was the "last civil right" but the progressives cannot leave it alone. This is the "slippery-slope argument," and, as any one of my AP English Language and Composition students can tell you, it's a LOGICAL FALLACY. Also, I'm pretty sure you don't know what you're talking about, because a "sex change" involves more than one surgery, usually. You also scrupulously avoid the fact that governments in certain states--NOT the Obama Administration--began this tempest in a teapot, by crafting legislation aimed to discriminate against the transgendered.

it is not a slippery slope argument, since all the letters refer to the fallacy of gender identity, and once one severs biological sex (chromosomes, genes, anatomy, biology, psychology) from gender identity, it logically applies to all. I doubt there is one letter on this list that you would say should not be there. You have bought the gender ideology hook, line and sinker. As to genital mutilation surgery, are you seriously suggesting this begin in a teenager? And, how much surgery did you mean when you raised your "solution" of "AFTER surgery?"

You are the person who brought up "teenagers"; when I mentioned a "transition process," I was referring to the series of operations that adults go through. Again, I very seriously doubt that you even know what you are talking about, because, if we had a doctor comment here, he would probably tell you that the "transition" process involves many hours of counseling, to determine if the patient is competent to make a decision that a "teenager" normally can't. That's routine in these kinds of medical procedures. Heck, I had to do psychological counseling when I donated a kidney. You think any sane physician is going to trust a TEENAGER to make such a decision? The very fact that you throw "teenagers" into the mix of this discussion indicates that you're dealing in hysteria--typical of the "culture warriors" of the Right. And there is no "gender ideology" I know of; there's only human biology and genetics. Even the "teenagers" would have been heavily counseled and psychologically evaluated; I KNOW this (and, if you're a "doctor," you do, too). It was explained to me when I was donating my kidney to my sister-in-law. You must be talking--ridiculously, in my opinion--about the "teenagers" who'd be "confronted" with a reality of life--which is that some few people are "in-between" in terms of the brain chemistry of hard-wired gender identity. I think it does young adults good to know this, and to accept it, and you evidently don't. You must be part of the crew who, decades ago, wanted to keep every "gay" person in the "closet," and not "out" to their communities and parishes. Pope Ratzinger thought that, and I bet you are disturbed that Pope Francis thinks differently regarding ministry to the "same-sex-attracted."

As to which side of the cultural divide is instigating this fight, see this just in re G.G. v. Gloucester County School Board, Judge Paul Niemeyer forcefully dissented. Some excerpts: "[T]he majority’s opinion, for the first time ever, holds that a public high school may not provide separate restrooms and locker rooms on the basis of biological sex. Rather, it must now allow a biological male student who identifies as female to use the girls’ restrooms and locker rooms and, likewise, must allow a biological female student who identifies as male to use the boys’ restrooms and locker rooms. Let's remember this political and social engineering mumbo jumbo, as many other evils, started with the manipulation of language. An unambiguous scientific term, "sex", was replaced with an poisonous ideological one, "gender" -some 25 years ago, as I recall. Now behold the consequences of the stupidity and superstitions of this Brave New World.

Pope Francis on the current revolt against our biological nature. “Yet another challenge is posed by the various forms of an ideology of gender that “denies the difference and reciprocity in nature of a man and a woman and envisages a society without sexual differences, thereby eliminating the anthropological basis of the family. On the other hand, “the technological revolution in the field of human procreation has introduced the ability to manipulate the reproductive act, making it independent of the sexual relationship between a man and a woman. It is one thing to be understanding of human weakness and the complexities of life, and another to accept ideologies that attempt to sunder what are inseparable aspects of reality. Let us not fall into the sin of trying to replace the Creator. We are creatures, and not omnipotent. Creation is prior to us and must be received as a gift. Below, I am not writing about the "high school students" who are, in the opinion of the reactionaries, going to be "offended" by seeing a sexually transitioning person, but about the person who is actually "sexually transitioning," whether that person is a teenager or an adult. I don't think there's any harm whatsoever in a young adult seeing naked bodies, whether they are the naked bodies of the opposite sex, or the naked bodies of the androgynous or the hermaphrodite. I'll gladly admit that mine is the perspective of one who was raised by nudists, but I don't think I was the least bit "damaged" by that. I think that all of you Right-wing Catholics have a terrible problem with a shame-inducing "Theology of the Body" that spouts romantic nonsense about "complementarity," but really can't deal with any kind of human body that isn't conventionally "normal." The problem for you, I guess, is that there's isn't much in God's world that isn't, according to your great queer-saint, Gerard Manley Hopkins, "counter, original, spare, strange."

Robert - being "raised by nudists" explains a lot. No wonder you think bathroom privacy is passé and why any non-nudist would be a reactionary to expect bathrooms be assigned by sex. As to residual damage from living in a nudist colony, perhaps, suppressed memories have not yet surfaced. In any case, the Christian command is that we love and have compassion for our neighbors, including those diagnosed with gender dysphoria. But, we are not called to have to have a rational lobotomy and deny the bleedin' obvious.

Why Robert - I thought you gave great credence to suppressed memories and desires that are only uncovered with deep psychoanalysis, but are otherwise unavailable to the mind. Isn't that the whole point of self-discovery in the modern psycho-industrial complex? As to ad hominem attacks, in this combox alone, you have used "ideology-mad fanatics," "hysteria," "hysterical," "reactionaries," and you have dismissed the words of Pope Francis that I quoted and the works of a saintly pope (you think his Theology of the body is “shame-inducing” and “spouts romantic nonsense”). So, getting offended now seems a little hypersensitive. I obviously hit a nerve, which could be a harbinger worthy of some more investigation. In any case, back to the discussion on hand. For high schools teenagers, don't you think genital anatomy would be the least disruptive determinant for assignment to bathrooms and showers? A compassionate non-ideological alternative could be single booth bathrooms and showers. Both of these solutions were working well enough in the public schools but have now been ruled out by the new Obama "guideline."

The Administration’s letter to its “colleagues” in the nation’s public schools brings to mind Little Red Riding Hood, standing innocently before the large, smiling figure in granny clothes, except for the disconcertingly big, sharp teeth. The Obama teeth emerge on page two of the Education Department’s letter: “As a condition of receiving Federal funds . . .” Yes, unless the schools “treat a student’s gender identity as the student’s sex for the purposes of Title IX,” the school district may lose federal funds.
The Obama Administration’s preoccupation with sex, whether in sophomore year or the fourth grade, raises questions about whether the federal bureaucracies know at all what they are doing on anything resembling the merits. The 2011 letter on sexual harassment waved into existence a long list of compliance measures that schools had to institute, including novel procedures for handling accusers and the accused. This has led to serious complaints that traditional due process is disappearing on campus.The new rules on transgender students push further into unknown territory. The Friday “Dear Colleague” letter posits that a student’s personal declaration of sexual gender, or what the letter calls “an individual’s internal sense of gender,” must be accepted without challenge.

Good article. The attack on federalism is just as bad - an Orwellian "guidance or else" dictate. I read that they used the word "guidance" to avoid Congressional oversight. Probably trying to sabotage Hillary's campaign?
